The terms and Conditions include the Conditions of use and Policies as well as the Specifications specified in the Appendix.

Welcome to Residanzia! By accessing or using the Residanzia platform (the “Platform”), you agree to comply with and be bound by the following Terms of Use and Policies. Please read them carefully.

1. Acceptance of Terms

By accessing or using the Platform, you agree to these Terms of Use and Policies, and you acknowledge that you have read and understood them. If you do not agree to these terms, do not use the Platform.

By accepting these Terms of Use and Policies you are also accepting the Residanzia’s Specifications posted on the platform’s website.

2. Use of the Platform

2.1 Eligibility You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement.

2.2 Account Registration To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

3. Listings

3.1 Listing Accuracy You are responsible for ensuring that any property listings you create are accurate and complete. Misleading or false listings are strictly prohibited.

3.2 Compliance with Laws All listings must comply with applicable national laws and regulations of the property. You are solely responsible for ensuring that your listings comply with these requirements.

4. Acceptable Use

4.1 Prohibited Activities You agree not to engage in any of the following prohibited activities:

  • Contacting directly the sellers or renter if interested in buying or renting 

  • Renting or buying the property whiteout the Knowledge of residanzia 

  • Posting false, misleading, or fraudulent information.

  • Violating any national laws or regulations.

  • Infringing on the rights of others, including intellectual property rights.

  • Using the Platform for any unauthorized commercial purposes.

  • Distributing viruses, malware, or other harmful software.

  • Engaging in any activity that disrupts or interferes with the Platform’s functionality.

  • Harassing, abusing, or harming other users.

  • Collecting or storing personal information of other users without their consent.

  • Attempting to gain unauthorized access to the Platform or its related systems or networks.

4.2 User Content You retain ownership of any content you post on the Platform. However, by posting content, you grant Residanzia a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute your content in connection with the operation of the Platform.

5. Fees and Payments

5.1 Fees If applicable, certain features of the Platform may require payment of fees. You agree to pay all applicable fees as described on the Platform.

5.2 Payment Terms All fees are non-refundable, except as expressly provided in these Terms of Use. Payment must be made through the payment methods provided on the Platform or as defined in the Specifications.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information about you.

7. Termination

7.1 Termination by Residanzia Residanzia reserves the right to terminate or suspend your account and access to the Platform at any time, without notice and for any reason, including for violation of these Terms of Use and Specifications.

7.2 Termination by You You may terminate your account at any time by following the instructions on the Platform. Upon termination, you must cease all use of the Platform.

8. Disclaimers

The Platform is provided on an “as-is” and “as-available” basis. Residanzia makes no representations or warranties of any kind, express or implied, regarding the Platform, including but not limited to its accuracy, reliability, or availability.

9. Limitation of Liability

To the fullest extent permitted by law, Residanzia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Platform; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Platform; (d) any bugs, viruses, trojans, or the like that may be transmitted to or through our Platform by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless Residanzia, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms of Use or specifications, or your violation of any rights of a third party.

11. Governing Law

These Terms of Use and any disputes arising out of or related to these Terms of Use or the Platform will be governed by and construed in accordance with the laws of property’s country, without regard to its conflict of law principles.

12. Changes to Terms of Use

Residanzia reserves the right to modify these Terms of Use at any time. We will notify you of any changes by posting the new Terms of Use on the Platform. Your continued use of the Platform after such notice constitutes your acceptance of the new Terms of Use.

Appendix: Specifications

Overview: 

Residanzia is a comprehensive real estate listing platform designed to connect buyers, sellers, renters, and agents. The app aims to provide a seamless user experience for discovering, listing, and managing properties. This document outlines the functional and technical specifications, as well as the  Rights, Obligations and Responsibilities of the Sellers and Renters, the Prospective Buyers and Tenants for the development of Residanzia.

Functional Specifications

1. User Roles and Authentication

  • User Roles: Buyers, Sellers, Renters, Agents, Admins. Sellers and Renters may be owners, Agents or Representatives.
  • Authentication: Email and password, social media login (Google, Facebook), two-factor authentication (2FA).
  • User Profile Management: Users can create and edit profiles with personal information, profile pictures, and contact details.

2. Property Listings

  • Create Listings: Sellers, agents and Representatives can create property listings with details such as:
    • Title
    • Description
    • Property Type (House, Apartment, Land, Room etc.)
    • Location (Address, City, State, Zip Code)
    • Price
    • Photos and Videos
    • Features and Amenities (Bedrooms, Bathrooms, Square Footage, etc.)
    • Availability (For Sale, For Rent)
  • Edit/Delete Listings: Users can edit or delete their listings.
  • Listing Categories: All, Buy, Rent, Residential Properties, Commercial Properties, Lands, Houses, Appartments, New Developments

3. Search and Filters

  • Search Functionality: Users can search for properties using keywords, locations, and categories.
  • Advanced Filters: Users can filter search results by:
    • Price Range
    • Property Type
    • Number of Bedrooms/Bathrooms
    • Square Footage (Surface or Dimensions)
    • Amenities (Pool, Garage, Garden, etc.)
    • Proximity to schools, transportation, and other points of interest
  • Map View: Interactive map showing property locations if applicable.

4. Property Details

The renter or seller is required to submit the pictures of only the interior of the property or house. They should not submit pictures of the storefront or outside or the entrance of the house.

  • Property Page: Detailed view of each property listing with:
    • High-resolution images or videos
    • Detailed description
    • Features and amenities
    • Location on map (if applicable)
    • Option to schedule a viewing (if applicable)
    • User reviews and ratings
    • Similar property recommendations

5. User Interaction

  • Favorites: Users can save listings to their favorites for later viewing.
  • In-App Messaging: Secure messaging system for users to communicate with sellers/agents (if applicable),
  • Reviews and Ratings: Users can leave reviews and ratings for properties and agents.
  • Notifications: Push notifications for new listings, price changes, messages, and other updates (if applicable).

6. Agent and Seller Tools

  • Dashboard: Sellers and agents have a dashboard to manage their listings, view inquiries, and track performance.
  • Analytics: Insights into listing views, user interactions, and market trends.
  • Lead Management: Tools to manage leads and follow up with potential buyers/renters (if applicable)

7. Admin Panel

The admin uses their panel to manage the application.

  • User Management: Admins can manage user accounts, approve or block users.
  • Listing Management: Approve, edit, or remove listings that violate terms of service.
  • Analytics and Reporting: Generate reports on app usage, popular listings, user engagement, and more.
  • Content Management: Manage app content, including FAQs, blog posts, and other informational resources.

    • Renters and Sellers: Have the right to access Residanzia’s platform to list and control the content of the properties for rent or sale, under certain conditions.
  2. Renters and sellers: Have the right to expect privacy and confidentiality regarding personal information shared on the platform, in accordance with Residanzia’s privacy policy.
  3. Fair and Non-Discriminatory Practices:
    • Renters and Sellers: Have the right to expect fair and non-discriminatory practices in all dealings facilitated through Residanzia, including property showings, negotiations, and transactions.

Obligations and Responsibilities of Sellers and Renters

1. Accurate Information Provision

  • Property Details: sellers or renters should provide accurate and comprehensive information about the property, including address, size, type, number of rooms, amenities, and any other relevant details.
  • Legal Status: sellers and renters should ensure that the property is legally available for sale or rent, with no outstanding legal disputes or encumbrances.

2. Honest Representation

  • Photos and Descriptions: The renter or seller is required to submit the pictures of only the interior of the property or house. They should not submit pictures of the storefront or outside or the entrance of the house. They should upload current and unaltered photos of the property. Ensure descriptions are honest and accurately represent the property’s condition and features.
  • Price Information: sellers and renters or their representatives should set a fair and honest price based on the property’s market value and condition.

3. Compliance with Laws and Regulations

  • Local Laws: sellers and renters or their representatives should comply with all local, state, and federal laws regarding real estate transactions, including zoning laws, housing standards, and landlord-tenant laws.
  • Disclosures: sellers and renters or their representatives make all legally required disclosures about the property, such as known defects, environmental hazards, or other pertinent information.

4. Property Accessibility

Sellers and renters or their representatives should:

  • Viewings and Inspections: Make the property available for viewings and inspections at reasonable times. Ensure the property is in a presentable condition during these times.
  • Contact Information: Provide accurate contact information and be responsive to inquiries from potential buyers or renters.

5. Document Preparedness

Sellers and renters or their representatives should:

  • Ownership Proof: Have documents proving ownership or authority to sell/rent the property ready for verification.
  • Lease Agreements: If renting, prepare a clear and lawful lease agreement that outlines terms and conditions, including rent amount, payment schedule, duration, and other relevant clauses.

6. Professional Conduct

Sellers and renters or their representatives should:

  • Ethical Behavior: Act in an ethical manner, avoiding any deceptive or misleading practices.
  • Transparency: Be transparent in all dealings, ensuring that potential buyers or renters are fully informed about the property and the terms of the sale or lease.
  • Keeping contact number: The renter or seller should not publish their personal contact or phone number on Residanzia platform.
  • Visiting the properties: The renter or buyer must pay a visit fee to Residanzia before seeing the property. Visiting the property to see it before renting or selling it is subject to the payment of visit fees of 2.000 FCFA that covers the expenses of the time, gas and phone calls spent to travel to the property place. If the renter or buyer rents or buys the property, this amount is deducted from the renter’s  or buyer’s payment. The renter or seller should show all the documentation to prove that they are the owner or the legal representative of the property.
  • Presence of Residanzia while signing the rental agreement or bill of sale: Buyers or renters should not sell or rent the property in the absence of Residanzia legal representatives. The renter agreement or bill of sale should be signed in the presence of Residanzia. 
  • If the customer rents the property: Upon the signature of the lease, the renter should pay a commission fee equivalent of one month rent to Residanzia.
  • If the customer buys the property: Upon the signature of sale contract, the seller should pay to Residanzia a commission fee of 10% of the sale price. 
  • The commission fee : It should be paid through cash, the app credit card option,  or one of the Mobile phone services provider like Moov, Tmoney, MTN… to the account of Residanzia. And the payment should be signed by both parties: seller and Residanzia.

7. Account Management

Sellers and renters or their representatives should:

  • Profile Accuracy: Maintain an accurate and up-to-date profile on Residanzia, including contact details and professional background if applicable.
  • Listing Management: Regularly update listings to reflect the current status of the property (e.g., if it has been sold or rented).

8. Marketing and Promotion

  • Marketing Content: Ensure that all marketing and promotional content is truthful and does not mislead potential buyers or renters.
  • Compliance with App Policies: Follow all guidelines and policies set forth by Residanzia for listing and promoting properties on the platform.

9. Resolution of Disputes

  • Dispute Handling: Be prepared to address and resolve any disputes that may arise in connection with the listing, viewing, sale, or rental of the property.
  • App Mediation: Utilize Residanzia’s dispute resolution mechanisms, if available, to handle conflicts with potential buyers or renters.

10. Payment and Fees

  • Service Fees: Pay any service fees or commissions owed to Residanzia as per their terms of service.
  • Transaction Transparency: Ensure that all financial transactions related to the property are transparent and documented online and physically.

By adhering to these obligations and responsibilities, sellers and renters can ensure a smooth and professional experience when using the Residanzia real estate listing app.

Rigths and Obligations of Prospective Buyers and Tenants Using Residanzia 

Rights of Prospective Buyers and Tenants

  1. Access to Property Listings
    • Prospective buyers and tenants have the right to access and browse property listings available on Residanzia.
  2. Privacy Protection
    • Residanzia must protect the privacy of prospective buyers and tenants, ensuring that their personal information is handled securely and in accordance with privacy laws.

Obligations of Prospective Buyers and Tenants

  1. Contacting Residanzia before renting or buying: Prospect Buyers and Tenants should rent or buy their chosen property through residanzia. Once they find a property on the platform they should contact Residanzia staff who will guide them to visit the property. They should not contact directly the seller or renter to rent or buy the property. If they contact the renter or seller directly this action will be considered as a violation of our present terms and agreements.
  2. Accurate Information
    • Prospective buyers and tenants must provide accurate and truthful information when registering on Residanzia and when making inquiries or offers on properties.
  3. Respect for Property
    • Prospective buyers and tenants must respect the properties they visit and handle any interactions with property owners, agents, or Residanzia staff professionally and ethically.
  4. Compliance with Terms of Use
    • Prospective buyers and tenants must comply with Residanzia’s specifications, terms of use and policies, including rules regarding prohibited activities and acceptable use of the platform.
  5. Payment of Fees
    • The renter or buyer must pay a visit fee to Residanzia before seeing the property. Visiting the property to see it before renting or selling it is subject to the payment of visit fees of 2.000 FCFA that covers the expenses of the time, gas and phone calls spent to travel to the property place. If the renter or buyer rents or buys the property, this amount is deducted from the renter’s  or buyer’s payment. The renter or seller should show all the documentation prove that they are the owner or the legal representative of the property.
  6. Notification of Interest
    • Prospective buyers and tenants should promptly notify the property Residanzia if they decide to rent or buy a property.
  7. Legal Compliance
    • Prospective buyers and tenants must comply with all national laws and regulations related to property rentals, including but not limited to lease agreements, property inspections, and payment obligations.

By adhering to these rights and obligations, both prospective buyers and tenants using Residanzia can contribute to a transparent, fair, and efficient property search and rental process.
